The extension of their remand resulted from the objection raised by their counsel, Mr. W. O. Toriola, who vehemently opposed that their plea be taken in a consolidated charge against the duo. At the resumed hearing of the matter yesterday, the prosecutor, Inspector Chinalu Uwadione, informed the court of an application by the police to substitute the charges against each of the defendants.
But their counsel, Toriola objected, saying that the business of the day was for the court to rule on their bail application. Toriola also informed the court that the police cannot apply for the substitution of the charges rather such can only be consolidated.
He therefore prayed the court for an adjournment, to enable him file a formal application in objection to the substitution of the charges against his clients. The Magistrate, Folashade Botoki, at the instance of the counsel, adjourned the matter till October 12, and ordered that the duo be returned to prison custody.
The 31 year-old truck driver, Wasiu Adeleke, was arraigned before the court on 11-count charge bordering on gross negligence and reckless disregard for human life, reckless and dangerous driving, driving in public highway without valid driver’s licence and a valid MOT Test Certificate. Similarly, the owner of the truck, Kilani Ojo Adesanya, 50, was arraigned on two-count charge of giving the truck to a driver without driving documents.
